Terms and Conditions 

  • Merchant terms and conditions apply

  • No time limit applies to vouchers and promotions 

  • Additional customers without a voucher will be charged full price

  • 24-hour cancellation policy or voucher is forfeited (voucher is void in case of no-show)

  • All deal inclusions must be redeemed in a single visit (unless specified as a multi-session deal)

  • Please expect a high demand for all bookings, especially at weekends and after 5 pm on weekdays.

  • All bookings are subject to availability, it is recommended to book well in advance

  • Merchants have the right to offer fixed availability for voucher holders to allow space for full-paying customers

  • No refunds if your preferred date is unavailable

  • Voucher cannot be combined with any other offers unless permitted by the merchant

  • Unused portions of the voucher are non-refundable and cannot be exchanged for other services or cash unless required by law

  • Vouchers are not for resale and not redeemable for cash

Wellness Membership

Terms and Conditions for Wellness Membership 

1. Available Booking times
Monday to Friday 9.30 to 5.30 pm

2. Family Appointments must come together (Family for billing purposes is max 2 adults and 2 Children)

3. Pre payments Only-Payment must occur at the start of the month of care not at the end of the month of care

4. Weekly care means you can come once a week for that month. Fortnightly care means that you can come once every 14 days. 

5. Appointments must be pre-booked in advance for the month

6. If less than 24 hours' notice of cancellation occurs, the treatment is void for that week. 

7. Not available Public Holiday

8. If additional care is needed within the month our team offers our wellness membership patients a discount rate 

9. Membership can have a start date at any time of the month, and then reoccurring due dates will be the same date. 

Bulk Billing Medicare, Gap Free DVA, TAC and Worksafe/Workcover

Terms and Conditions for Wellness Memberships.

  • Department of Veteran Affairs patients must bring a copy of their gold card or white card so our team can note their details and what condition they can treat ( gold cards do not need to have a specific condition) 

  • Medicare- Patients must bring an EPC/CDM form from the G.P. The Bulk billed session is for a New Patient consultation or Standard Consultation. For other sessions, the patient will have to pay a gap, due on the day. 

  • TAC- Workcover- The patient will need to provide staff with the claim number, client liaison contact and how many sessions they are approved for. Gap-free sessions are for New patients and standard consultations. Other sessions are available but a gap will have to be paid on the day. 

  • Missed appointment, Late Cancellation- The patient will still be subject to a fee which is payable to the team. An email will be sent on the day informing the patient of a missed appointment, the fee and a link to rebook.

- Points are not counted for  Gap Free sessions including Pro Bono, Bulk Billed, Tac, Workcover, DVA, and any other promotional price. 

- once you have accumulated enough points, our team will email you a voucher and the voucher is valid for 30 days. 


Terms And Conditions at Health Wise Chiropractic 
 

  1. IMPORTANT
    a. Please read these terms and conditions carefully.
    b. All bookings made via Participating Websites or with Health Wise Chiropractic directly are made subject to these terms and conditions and the person making the booking will be deemed to have accepted these Terms and Conditions on behalf of all persons who will be consulting the Practitioner under the booking once any payment is made about the booking.
    c. Bookings may also be governed by and subject to additional terms and conditions which are applied by the Practitioner. These terms and conditions may relate to items such as payments, deposits and cancellations and you should confirm the exact conditions directly with the Practitioner before booking. If there is any inconsistency between the Practitioner’s terms and conditions and these Terms and Conditions, the latter will prevail.
    d. Any prices, fees, deposit amounts or charges which are specified or referred to in these terms and conditions are in the same currency as the booking to which they relate.

  2. Definitions
    In these Terms and Conditions:
    a. “Prepaid Booking” means a booking for any Practitioner which is advertised as a Prepaid Booking or which you have been notified by Health Wise Chiropractic is a Prepaid Booking or which is listed on a Participating Website or Health Wise Chiropractics’ Website as a Prepaid Booking.
    b. “Adolescent” has the meaning given in clause 16.
    c. “Booking Credit” means credit that may be applied to future service bookings with Health Wise Chiropractic subject to clause 12.
    d. “Gift Card” means an official gift card affiliated with Health Wise Chiropractic.
    e. “Child” and “Infant” have the meanings given in clause 16.
    f. “Health Wise Chiropractic” means Julian Simpson ABN 16 691733612 trading as Health Wise Chiropractics.
    g. “Practitioners” means any Practitioners associated with Health Wise Chiropractic.
    h. “Participating Website” means the Health Wise Chiropractic website and any websites that act as an official partner with Health Wise Chiropractic.
    i. “Standard Booking” means a booking at any Practitioner other than a Prepaid Booking.
    J. “You” and “Your” mean the person who is making the booking.

     

  3. Photographic Identification
    a. When you arrive for your prepaid service, you may be asked to provide photographic identification for the student, staff or concession discounts.
    b. If you are unable to provide such identification your discount may be cancelled and you may be liable to pay Health Wise Chiropractic an additional amount equal to the full booking amount.

  4. How To Book for Services
    a. Bookings can be made online via the www.healthwisechiropractic.com.au Website, by emailing dr.julian@healthwisechiropractic.com.au(appointment is not made until you receive confirmation) or at Health Wise Chiropractic directly by walking in or calling our clinic on 03 9467 7889 or 0428993799.
    b. Bookings are subject to the availability and applicable pricing of the relevant Participating Practitioner at the time of the booking and some conditions and/or exclusions may apply including but not limited to minimum service requirements.
    c. Any quote given is an estimate only of price and the price will only be confirmed once a payment is made on the booking and you receive written advice from Health Wise Chiropractic that the payment has been received and the booking has been confirmed.
    d. Any confirmed price is subject to change if:
    d.i. a payment which is due on a booking is not received by Health Wise Chiropractic by the date the payment is due; or
    d.ii. there is a change in or imposition of a government charge, tax or levy that entitles or necessitates Health Wise Chiropractic to change the price of your booking.
    d.iii. any details relating to your booking are amended, for example, your type of service, in which case clause 9 will apply.
    e. If the price of a booking is changed under clause 4.d you may pay the new price for your booking or cancel your booking and receive a full refund.
    f. If you reasonably believe a written confirmation or invoice which has been provided to you is incorrect, you can request that Health Wise Chiropractic reissue that written confirmation or invoice and you may either pay the amount specified on the reissued written confirmation or invoice by the date which it is specified as being due or cancel your booking.
    g. If you make a booking via a Participating Website you can view details of your booking once you access the Participating Website using the login details you created when you made the booking.

  5. Payment
    a. Payments may be made by Visa, Mastercard, Diners, American Express, Health Insurance, Medicare, Cheque, PayPal or Australian Dollars.
    b. Internet banking payment is available only for prepaid bookings and using an Australian bank account.
    c. A surcharge might apply to payments made by Visa, Mastercard, Diners, American Express and PayPal. The surcharge applied to these cards may vary and is displayed at the time payment for the booking is to be made if applicable. No surcharge will be applied to payments made using Australian Dollars or internet banking.
    d. Health Wise Chiropractic accepts no responsibility for monies paid by you to any agent until cleared funds are received in the bank account of Health Wise Chiropractic.

  6. Final Payment
    a. For Prepaid Bookings, a non-refundable payment of the entire amount payable per service must be received immediately at the time of booking to confirm your booking. For non-paid bookings, full payment is to be made at the time of the appointment.
    b. If any deposit or final payment is not received by the due date, Health Wise Chiropractic reserves the right to cancel the booking and any monies paid by you about your booking will be forfeited to Health Wise Chiropractic.
    c. Once final payment of your booking has been made confirmation of that payment and your booking will be sent to you via email to the email you provided at the time you made the booking.

  7. Rates and Charges
    a. The currency applicable to any quoted prices will be specified with the quoted rate. All quoted rates are subject to change at any time until full payment is received.
    b. Quoted prices are inclusive of all compulsory government or regulatory charges and taxes (for example GST) where applicable.
    c. For information on rates for Adolescents, Children, Infants and extra persons, please refer to clauses 16.
    d. Please visit the www.healthwisechiropractic.com.au website or contact the clinic for further information on specific inclusions and exclusions.

  8. Refunds
    a. To the extent permitted by law any amount paid by you to Health Wise Chiropractic for your booking is non-refundable unless stated otherwise in these Terms and Conditions.
    b. The balance of any monies paid by you after any applicable fees or other amount you owe to Health Wise Chiropractic has been deducted will be held by Health Wise Chiropractic as Booking Credit which subject to clause 12 may be applied to any future bookings you make with Health Wise Chiropractics.

  9. Amendments
    a. All amendments are subject to the availability and applicable pricing of the relevant Practitioner at the time the amendment is requested.
    b. Amendments for Prepaid Bookings to another day may be requested up to 24 hours before your scheduled appointment time.
    c. If amendments are requested outside the time frames specified in clause 9. b. you may be charged a 50% cancellation fee in addition to the cost of your amended booking and any reduction in the amount which is payable by you in such case will be at Health Wise Chiropractics’ absolute discretion.
    d. Amendments may be requested via a Participating Website or via our clinic reception service in person or by calling 03 9467 7889.
    e. If the rate that applies to an amended booking is greater than the rate that applied to the original booking, you must pay the difference along with any amendment fee in full at the time the amendment is approved.

  10. Cancellation
    a. If a booking is cancelled any non-refundable payment which you have paid will not be refunded and additional cancellation charges may apply under this clause 10.
    b. Within 24 hours of your scheduled appointment: a 50% cancellation fee will apply and you will be required to pay Health Wise Chiropractic 50% of the the full amount of your booking less any amount that you have already paid.
    c. For Prepaid Bookings, if you cancel your booking the full amount of your non-refundable booking payment paid under clause 6.b will be retained by Health Wise Chiropractic as a cancellation fee.
    d. Where applicable the balance of any monies paid by you after any applicable cancellation fee has been deducted will be held by Health Wise Chiropractic as Booking Credit which subject to clause 12 may be applied to any future bookings you make with Health Wise Chiropractic.

  11. No-Shows or Terminations
    a. If you do not show up for your booking or terminate your booking early after you have commenced your appointment you will be charged a 50% cancellation fee and will be required to pay to Health Wise Chiropractic the full amount immediately less any amount which you have already paid.

  12. Booking Credit
    a. If you are issued with Booking Credit to be applied to future appointments with Health Wise Chiropractic such credit will be valid for six months from the day the booking is cancelled.
    b. Booking Credit may only be used to pay for bookings at Participating Practitioners located within the same clinic as the cancelled or refunded booking that generated the Booking Credits.
    c. Booking Credit may only be used to pay for the appointment or fees such as cancellations fees and may not be used for items such as products not included in the appointment.
    d. To redeem Booking Credit you must make your booking via Health Wise Chiropractic by calling 03 9467 7889.
    e. Any service to be fully or partly paid for using Booking Credit must be booked and paid for in full before the expiry of the 6-month validity period.
    f. Any Booking Credit not redeemed at the expiry of the 6-month validity date will be forfeited in its entirety to Health Wise Chiropractic.
    g. Administration fees may apply to bookings made using Booking Credit.

  13. Appointment Check In
    a. Standard check-in time is by the time of the appointment and it will be considered as a no-show 5 minutes after that time. In this case, Clause 11 is engaged.
    b. You will be considered checked in at the time you present yourself to our staff in the clinic or at the time you register your arrival with our automated systems.

  14. Check-out
    a. Standard check-out time is done by finalising your payment with our staff or with our automated systems.

  15. Practitioner Allocation
    a. In the unlikely event that Health Wise Chiropractic cannot provide the Practitioner with whom you have booked, Health Wise Chiropractic will at no additional expense to you re-book you with an equivalent Practitioner in the same clinic if possible.
    b. If another Practitioner is not available at the time of your appointment, Health Wise Chiropractic may re-book you to a later date and time for the type of service for which you had booked.
    c. Should you wish to be re-booked to an alternative Practitioner other than the Practitioner chosen by Health Wise Chiropractic under this term, you will be required to pay any difference in price between Health Wise Chiropractic’s choice of Practitioner/service and your chosen Practitioner/service.
    d. If you and Health Wise Chiropractic cannot agree on an alternative property under this clause then you may request Health Wise Chiropractic cancel your booking and issue you with a Booking Credit for the full amount of that booking less any amounts which you owe to Health Wise Chiropractic.
    e. If you and Health Wise Chiropractic cannot agree on an alternative property under this clause and you do not wish to be issued a Booking Credit under clause 15.d then you may request that Health Wise Chiropractic cancel your booking and provide you with a refund for the full amount of that booking less any amounts which you owe to Health Wise Chiropractics.

  16. Child Policy
    a. For the purposes of this clause “Adolescent” means a person aged between 13 and 18 years; “Child” or “Children” means a person or persons aged between 2 years and 12 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged over 18 years. All ages will be determined from the date at which the appointment is to occur.
    b. Children and Infants are to be accompanied by their parent(s), step-parent (s), guardians or other adult who has parental rights and responsibilities for their appointments.
    c. We do not provide creche or child care/child minding services for Children and Infants.
    d. Adolescents are to be accompanied by their parents or guardians at their initial consultation and any diagnostic / report of findings appointments.

  17. Services
    Whilst care is taken to ensure that the description of services of the Health Wise Chiropractic is accurate, these are continually being changed, upgraded, and on occasion taken out of service and if any feature is essential to you in choosing a particular service, it is your responsibility to confirm with the Practitioner before making your booking that the feature will be available during your appointment.
    To the extent permitted by law Health Wise Chiropractic is not liable for omissions, errors or changes to the features and services at the clinic, whether temporary or permanent.
    The features listed may not apply to all services.

  18. Special Requests
    Whilst Health Wise Chiropractic attempts to satisfy all special requests, Health Wise Chiropractic does not guarantee that special requests can be accommodated.

  19. Maps and Images
    Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided.

  20. Gift Vouchers
    a. Gift Vouchers are not refundable or redeemable for cash.
    b. Gift Vouchers issued prior to 31st March 2018 are valid for 6 months from the date of issue. Gift Vouchers issued after 31st March 2018 are valid for 3 years unless one of the following exemptions apply:

    Gift cards supplied as part of a customer loyalty or employee rewards program
    A gift card or voucher supplied as part of a temporary marketing promotion as a bonus to the purchase of a good or service
    A gift card or voucher sold for a particular good or service that is below the market value of the good or service (a genuine discount)
    A gift card or voucher sold or donated for use in a fundraising appeal, including to a charity or not-for-profit organisation
    A gift card or voucher exchanged for goods returned to the supplier of the goods
    A gift card or voucher for a good or service available for a limited time where the card or voucher expires at the end of that period (for example, entry to a concert or museum exhibition, or a pair of shoes that is only available for a limited time)If a Gift Voucher falls under one of the above exemptions it will generally have a 6 month expiry except for the last exemption listed above which is limited to a specific time and or date.
    c. Additional values cannot be added to an existing Gift Voucher; however, additional Gift Vouchers can be purchased.
    d. A credit card surcharge may apply if Gift Vouchers are purchased using a credit or debit card.
    e. Gift Vouchers are to be treated like cash and if they are defaced, mutilated, altered, lost or stolen they will not be replaced, refunded or redeemed.
    f. Health Wise Chiropractic does not accept any responsibility for lost or stolen Gift Vouchers.
    g. Gift Vouchers are issued in Australian dollars (AUD) and:
    g.i. the value nominated on the Gift Voucher may only be used to fully or partially pay for bookings for services;
    g.ii. bookings using Gift Vouchers must be made in person, over the phone or via email in accordance with clause 4.

  21. Gift Cards
    a. Third-party Gift Cards will only be applicable if they are officially affiliated with Health Wise Chiropractic. Health Wise Chiropractic will not be at fault or liable for the third-party gift card if they are not affiliated.
    b. All third-party gift cards are for regular services and can not be used in conjunction or combination with other promotions or discounts that Health Wise Chiropractic.
    c. Health Wise Chiropractic reserves the right to not recognise a third-party gift card if its value or validity can not be identified.

  22. Unaccompanied Minors
    a. All bookings under the age of 13 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 18-year-old guest.
    b. If a guest is found to be a person under the age of 13 who is not accompanied by a responsible adult Health Wise Chiropractic may immediately cancel the booking and 50% of the full booking amount will be forfeited to Health Wise Chiropractic under this clause.

  23. Third Party Products and Services
    a. Third-party products or services are sometimes sold together with accommodation provided by Health Wise Chiropractic. In such circumstances the third party is entirely responsible for supplying the products or services to you and any involvement Health Wise Chiropractic has in facilitating your booking with the third party is as the third party’s agent. Health Wise Chiropractic is in no way the supplier of the products and services and to the extent permitted by law. Health Wise Chiropractic is not liable for any failure by the third party to provide the products or services nor for any act, error, omission, default or negligence of the third party.
    b. All third-party coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those third parties.
    c.Health Wise Chiropractic does not warrant the accuracy of any information, statements or representations made by third parties

  24. Release, indemnity and proportionate liability
    a. To the extent permitted by the law, you agree to release, indemnify and hold harmless, Health Wise Chiropractic and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking with the relevant Practitioner except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arising out of, was caused by, attributable to or resulted from Health Wise Chiropractics’ negligence, wrongful act/omission or breach of these terms and conditions.
    b. To the extent permitted by law the aggregate of Health Wise Chiropractics’ liability to you is limited to an amount not exceeding the amount paid by you for your booking.
    c. Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.

  25. Consumer Law
    a. To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Health Wise Chiropractic are excluded under these Terms and Conditions.
    b. Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits Health Wise Chiropractic to limit its liability, then Health Wise Chiropractic’ liability is limited to:
    b.i. in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
    b.ii. in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

  26. Events Beyond Control
    a. Health Wise Chiropractic is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.
    b. All documents, observance of laws and government regulations are your responsibility.

  27. Use of Information
    a. You consent and authorise Health Wise Chiropractic and the relevant Practitioner to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
    b. You consent to information that you have provided to Health Wise Chiropractic or the relevant Practitioner as part of your booking being used by Health Wise Chiropractic, the relevant Practitioner or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate Health Wise Chiropractic, Health Wise Chiropractics’ related bodies corporate or Practitioners.
    c. Health Wise Chiropractic will not provide or disclose any information you have provided to Health Wise Chiropractic or the relevant Practitioner to any person other than a related body corporate without your prior written consent.
    d. Upon request by you and to the extent permitted or required by law, Health Wise Chiropractic will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.

  28. General
    a. The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of Victoria, Australia.
    b. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

  29. Acceptance
    a. You accept these terms and conditions, by making a booking with Health Wise Chiropractic.
